These Terms of Service ("Terms") govern your use of the mNeuroMap application and website (the "Service") provided by PathoBrainSeq ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.
1. Description of Service
IMPORTANT MEDICAL DISCLAIMER
mNeuroMap is a brain health wellness tracking tool. It is not a medical device, does not provide medical diagnoses, and is not intended to replace professional medical evaluation. The PBSeq Brain Wellness Assessment (PBWA™) provides wellness awareness information only. Always consult a qualified healthcare professional for medical concerns.
mNeuroMap provides:
- Cognitive and motor wellness self-tracking through the PBWA™ assessment
- Longitudinal comparison of your wellness scores over time
- Digital biomarker collection for personal wellness awareness
- Optional voice and motor function tracking modules
mNeuroMap does not provide:
- Medical diagnoses or clinical assessments
- Treatment recommendations
- Medical device functionality regulated by the FDA
- Replacement for professional neurological or cognitive evaluation
2. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement.
3. Account Registration
- You are responsible for maintaining the confidentiality of your account credentials
- You are responsible for all activities that occur under your account
- You agree to provide accurate and complete information when creating an account
- You must notify us immediately of any unauthorized use of your account
4. Beta Program
Beta Notice: mNeuroMap is currently in beta testing. During the beta period, the Service may contain bugs, errors, or incomplete features. We appreciate your feedback and patience as we improve the product.
As a beta participant, you understand and agree that:
- The Service is provided "as is" during the beta period
- Features may change, be modified, or be removed without prior notice
- Data collected during the beta period may be used to improve the Service (in aggregated, de-identified form)
- We may reset or clear beta data before the official launch
- You may provide feedback, which we may use without obligation or compensation
5. Subscription Plans
5.1 Plan Tiers
mNeuroMap offers four subscription tiers: Free, Plus ($5.99/month), Premium ($15.99/month), and Precision ($49.99/month). Features and pricing are described on our pricing page and may change with notice.
5.2 Billing
- Paid subscriptions are billed monthly
- You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period
- We do not provide refunds for partial months
- Price changes will be communicated at least 30 days in advance
5.3 NeuroMap Discount
Precision subscribers are eligible for a 20% discount on the NeuroMap (WGS + scRNA-seq) service package. NeuroMap pricing and availability are provided upon request and are subject to separate terms.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to the Service or its systems
- Reverse engineer, decompile, or disassemble the Service
- Use the Service to collect information about others without their consent
- Interfere with or disrupt the Service or its infrastructure
- Use the Service as a substitute for professional medical advice, diagnosis, or treatment
- Share your assessment results as if they constitute a medical diagnosis
7. Intellectual Property
7.1 Our Property
The Service, including the PBWA™ assessment methodology, scoring system, digital biomarker analytics, software, design, content, and trademarks, is owned by PathoBrainSeq and protected by intellectual property laws. All rights reserved.
7.2 Your Data
You retain ownership of your personal data and assessment results. By using the Service, you grant us a limited license to store, process, and display your data solely for the purpose of providing the Service to you.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." PATHOBRAINSEQ MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
Specifically:
- PBWA™ scores are for wellness awareness only and have not been validated as clinical diagnostic tools
- Digital biomarker metrics are informational and should not be used for medical decision-making
- Wellness score ranges (Good, Monitor, Changes Observed, Consult Recommended) are general guidance, not clinical classifications
- We make no claims regarding the clinical accuracy, sensitivity, or specificity of any assessment
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PATHOBRAINSEQ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of data or assessment results
- Reliance on wellness scores for medical decisions
- Service interruptions or downtime
- Errors in assessment scoring or biomarker calculations
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to indemnify, defend, and hold harmless PathoBrainSeq and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.
11. Health-Related Limitations
If you are experiencing a medical emergency, call 911 (US) or your local emergency number immediately. Do not rely on mNeuroMap for emergency medical situations.
- mNeuroMap results should not delay seeking medical attention
- A "Good" wellness score does not guarantee the absence of neurological conditions
- A "Consult Recommended" score does not constitute a diagnosis
- Changes in wellness scores over time may reflect many factors beyond neurological health
- Always discuss your wellness tracking results with a qualified healthcare professional
12. Termination
- You may terminate your account at any time by contacting us
- We may suspend or terminate your account if you violate these Terms
- Upon termination, you may request deletion of your data pursuant to our Privacy Policy
- Provisions that by their nature should survive termination (including Disclaimers, Limitation of Liability, and Indemnification) will survive
13. Governing Law and Disputes
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Santa Clara County, California.
14. Changes to These Terms
We may modify these Terms at any time. Material changes will be communicated by posting a notice within the app at least 30 days before they take effect. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and PathoBrainSeq regarding the Service and supersede all prior agreements.
